By using Ubid.lk, Services, Advertisers and Users accept the following Terms and Conditions, as well as the manner in which Ubid.lk operates. These Terms & Conditions constitute the entire agreement between Ubid.lk and Advertisers and Users or You, and supersede and replace all prior commitments, undertakings or representations, whether written or oral, between Advertisers or Users and Ubid.lk with respect of use of Ubid.lk.

Information on Ubid.lk, such as the "About Us" or "FAQ" section, are only recommendations and are not intended as guidelines. Ubid.lk is not liable or responsible for the actions of users or other individuals who have read or been informed of such information or other written material.

Ubid.lk undertakes to follow all local tax legislation for the sale of coin packages and goods in the countries in which it operates, such as payment of VAT

1.2      Further, Advertisers and users are responsible for ensuring that advertising content, text, images, graphics, and video ("Content") uploaded for Ubid.lk complies with all applicable laws. Ubid.lk no responsibility for any illegality or any inaccuracy of the Content.

1.3      The advertisers and user guarantees that his or her Content do not violate any copyright, intellectual property rights or other rights of any person or entity, and agrees to release Ubid.lk  from all obligations, liabilities and claims arising in connection with the use of (or the inability to use) the service.

1.4      Ubid.lk reserves the right to change these Terms & Conditions at any time without notice to Advertisers and users.

2.        Acceptance of Terms & Conditions

2.1      By accepting the Terms & Conditions and/or registering with Ubid.lk, Advertisers and users confirm that You are eligible (as specified in the "Eligibility" section) to use Ubid.lk and you are hereby agreed not to damage, interfere with, or corrupt the Website or its normal functioning

2.2      If Advertisers and users do not agree to the Terms & Conditions, please do not use Ubid.lk.

2.3      If Advertisers and users access and use any service from Ubid.lk, You are agree to and are bound by these Terms &Conditions.

2.4      When using the Ubid.lk Services offered on the Website, Advertisers and users are agreed to disclose only truthful and correct information.

2.5     Advertisers and users are agreed not to use the Website to distribute spam, chain mail, pyramid schemes, viruses or any other information or technology deemed inappropriate by the Website Provider. The Website Provider reserves the right to take any measures deemed appropriate to stop the Customer from misusing the Website.

2.6     Advertisers and users are to understand and accepts that the Website Provider is not an agent, employee, broker, or representative of the Customer. Customer also understands that the Website Provider does not owe the Customer any duties other that those expressly set forth in these Terms and Conditions

3.        Eligibility

3.1      By accepting the Terms & Conditions and/or registering on Ubid.lk, Advertisers and users confirm that You are at least 18 years of age and at least age of majority subject to the laws of the state; therefore You can engage in a binding contract. By using Ubid.lk, Advertisers and users warrant that You have the right, authority, and capacity to enter into this agreement and to abide by all of the Terms & Conditions. By registering on Ubid.lk, the user declares that they are legally capable of entering into binding contracts.

3.2      Ubid.lk reserves the right to limit the number of user accounts per household. A user may not use any external software to automatically place bids in the auctions.

3.3      Ubid.lk reserves the right, at its sole discretion, to deactivate any user's account based on suspicion of the use of such software.

4.        Copyright

4.1     Advertisers and users grant Ubid.lk a perpetual, royalty-free, irrevocable ,non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such Content or incorporate such Content into any form, medium, or technology now known or later developed.

4.2      The material (including the Content, and any other content, software or services)contained on Ubid.lk, its subsidiaries, affiliates and/or third party licensors. Any intellectual property rights, such as copyright, trademarks, service marks, trade names and other distinguishing brands on the Web Site are the property of Ubid.lk .To be clear: No material on this site may be copied, reproduced, republished, installed, posted, transmitted, stored or distributed without written permission from Ubid.lk.

4.3      TheUbid.lk shall not be liable for damages caused by Customer unlawful activities and/or unacceptable conduct. Any user of the Website who engages in unlawful activities shall be liable to the Website Provider for any losses and/or expenses caused by such activity, including reasonable collection fees, lawyers' fees, incidentals, court costs, and such costs and expenses arising from the Customer's unlawful activities and/or unacceptable conduct herein.

4.4      You are agreed not to collect and/or retain any information about other users on and off the Website, including e-mail addresses, without the consent of such users, and/or the Website Provider.

5.        Registering

5.1     Advertisers and users hereby declare and warrant that You are at least 18 years of age and at least age of majority subject to the laws of the state, therefore You can engage in a binding contract; You reside in a jurisdiction in which Ubid.lk operates; Your user account may be used only by You and not by anyone else. All information that you provide us during the term of validity of this agreement, is true, complete, and correct, and that you shall immediately notify us of any change of such information.

5.2     Advertisers and users are allowed to have only one account. If you attempt to open more than one account, all accounts you try to open may be blocked or  closed.

5.3      As part of the registration process Advertisers and users have to choose your user name and password and to proceed over an OTP verification process for initial login to Ubid.lk. Individual usernames will be awarded on a first-come, first-serve basis.

5.4      During the registration process, you must choose a username, which must not in any way be offensive, indecent, insulting or intended to deceive or mislead other users or persons, whether intentionally or unintentionally.

5.5      Nor may a user name advertise for or promote any other websites or services, provide links to or for other websites.

5.6      Please note that Ubid.lk reserves the right to change usernames, for whatever reason, and is the final arbiter on policy.

5.7      Ubid.lk will never ask for password of Advertisers and users apart from login. Advertisers and users are solely responsible for Your user account password and its preservation. We suggest that not to provide your password to anyone, including Ubid.lk employees. User accounts are non-transferable.

5.8      Ubid.lk is not responsible for any abuse or misuse of your account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.

6.        Watermarks

6.1      All images on Ubid.lk will be watermarked to prevent the images to be used for other purposes, without the consent of the advertiser.

7.        Safety& images

7.1      Ubid.lk reserves the right to change the title of the content at any time for the advancement of the site and reserves the right not to publish images that are irrelevant or images that violate Ubid.lk rules.

7.2    Advertisers and Users shall not interfere with other users in any way on the Website.

7.3     Advertisers and Users shall not submit or transmit any file which contains viruses, worms, "Trojan horses" or any other contaminating or destructive features onto the Website.

8.        Your Price

8.1      Users can place the intended or required price by manually clicking the relevant "Your Price" button, each price will be placed upon an OTP verification until the available coin pack limit is reached. 

8.2      In addition to free coin pack allocation, Coins can be purchased in advance in the form of "Coin Packs". Ubid.lk reserves the right to offer different size Coin Packs at different times; also,Ubid.lk could offer free Coin packs at its sole discretion. All purchase coin packs are non-refundable. All unused coin packs are non refundable and nontransferable.

9.        How the This Works

9.1      With each price placed, the price of the item on which the user is placed the price would increases or decreases. When the price is placed, number of available Coins are deducted from the user's Coins account. Used Coins are non-refundable.

9.2      The countdown time is indicated for each advertisement  set by the individual advertiser or user. Placed price list will be notified to the respective advertisers who will have the right to accept on their discretion.

9.3      Ubid.lk is not responsible for disruptions in the user's connection and errors that may occur as a result of this. This includes, but is not limited to, incorrect countdown of the remaining time, outdated information on prices.

9.4     Advertisers or Users will incur delivery charges.

10.      Junkyard

10.1   Ubid.lk, at our sole discretion, also offer users a "Junkyard" option. The Junkyard option allows a user to buy the industrial, construction, retail, Electronic and domestic wastes & unwanted products. It gives the user the option to purchase the waste products directly from advertisers.

10.2   Auctions which are provided by the Ubid.lk, The user who was the last to place the highest bid wins the auction and can purchase the product from Ubid.lk. Purchasing of a Bid pack is mandatory in order to be eligible for such auctions.

11.      Memberships

11.1   As part of a membership package, Ubid.lk will create a Shop on behalf of the user. A Shop is a dedicated webpage on Ubid.lk, maintained by Ubid.lk. Users have the right to select any package at their discretion.

11.2   Ubid.lk reserves the right to modify or change membership packages, including the price and the contents of the membership package.

11.3   Ubid.lk is not obligated to refund money or services if a membership package is cancelled early, for any reason.

12.      Email address of users 

12.1   It is a mandatory to submit a valid email address prior to post an advertisement. The email addresses so submitted are not publicly displayed in the site and other users may send emails only throughUbid.lk.

13.      Privacy

13.1   Ubid.lk is expressly authorized by the users and advertisers to disclose the information collected from such parties to the Affiliate companies and internal administrative purposes.

14.      Cookies 

14.1   Ubid.lk uses cookies, therefore you may have cookies enabled on your computer in order floral the functions on the site to work on a proper manner.

15.      Site availability

15.1   Ubid.lk does not guarantee continuous or secure access to the Web Site. The Web Site is provided" as is" and as and when available.

16.      Disclaimer

16.1   Ubid.lk holds no responsibility what so ever for the use of Ubid.lk and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to

(a)       Any errors on Ubid.lk or the Content, including but not limited to technical errors and typographical errors.

(b)       Any third party web sites or content directly or indirectly accessed through linking Ubid.lk.

(c)       The unavailability of Ubid.lk

(d)      Your use of Ubid.lk or the Content, or

(e)      Your use of any equipment (or software) in connection with Ubid.lk 

17.      Indemnification

17.1   Advertisers and users agree to indemnifyUbid.lk as well as its officers, directors, employees, agents, from and again stall losses, expenses, damages and costs, including attorney's fees, resulting from any violation of this Terms and Conditions(including negligent or wrongful conduct).

18.      Modification

18.1   Ubid.lk reserves the right to modify these Terms and Conditions. Such modifications will be effective immediately upon posting on Ubid.lk. You are responsible for there viewing of such modifications. Your continued access or use of Ubid.lk shall be deemed your acceptance of the modified terms and conditions.

19.      Refund Policy

19.1   Ubid.lk does not provide any guarantee on accuracy or the availability on sellers listings, acceptance of their return item or any refund. 

19.2   Membership packages and coin packages are non-refundable.

20.      Applicable law

 20.1   Ubid.lk is operated under the laws and regulations of Sri Lanka. The courts of Sri Lanka will have the jurisdiction over any dispute or claim relating to the use of Ubid.lk
